1. Applicability of the terms and conditions

1.1 These Terms and Conditions govern all offers, orders, agreements, and other legal relationships between the Buyer and the Seller regarding the use of the Website, including the purchase and sale of Products through the Website.

 

2. Formation of the agreement

2.1 An Agreement is concluded when the Seller accepts an Order placed by the Buyer. The process is as follows:

  • The Buyer selects a Product, chooses the size, and adds it to the shopping cart.

  • The Buyer completes the following steps:

    • Step 1: Provide address details (billing and/or shipping address).

    • Step 2: Review the Order.

    • Step 3: Select a payment method and complete payment (if applicable).

  • The Order is placed, and the Buyer receives an email confirmation.

2.2 The Seller reserves the right to reject an Order in the following cases:

  • If the Order exceeds a value of €1,000.

  • If the Buyer’s information is incorrect or incomplete.

  • If payment is not received within the agreed timeframe.

  • If the Buyer has a history of non-payment or uncollected Orders.

  • In case of clear pricing errors on the Website.

2.3 The Seller will notify the Buyer promptly if an Order is not accepted.

 

3. Delivery methods and timeframes

3.1 Products will be shipped via a carrier designated by the Seller.

3.2 Delivery will occur within 5 days after receipt of payment, unless otherwise agreed.

3.3 If delivery is delayed or cannot be fulfilled, the Buyer will be notified within 5 days and has the right to cancel the Agreement free of charge.

3.4 Risk of damage or loss of Products transfers to the Buyer upon delivery.

 

4. Price and paymeny

4.1 Prices on the Website are in euros, inclusive of VAT.

4.2 Payment is required in advance through available payment methods (e.g., iDEAL, PayPal, credit card).

4.3 In the event of late payment, the Buyer is in default, and statutory interest may apply.

 

5. Return policy

5.1 The Buyer has the right to return Products within 14 days of receipt without stating a reason. Conditions:

  • Products must be unworn, unwashed, and undamaged.

  • Original packaging and labels must remain intact.

  • Return shipping costs are the responsibility of the Buyer.

5.2 The Seller will refund the Purchase Price within 14 days after receiving the return.

 

6. Force majeure

6.1 The Seller is not liable for delays or non-performance caused by circumstances beyond its control, including but not limited to war, natural disasters, strikes, or supply chain disruptions.

 

7. Complaints

7.1 Complaints about Products must be reported in writing within a reasonable timeframe to info@prestazione.com

7.2 The Seller will respond to complaints within 14 days of receipt.

 

8. Intellectual property rights

8.1 All trademarks, names, logos, and designs associated with the Products are owned by the Seller and may not be used without prior permission.

 

9. Applicable law and disbutes

9.1 These Terms and Conditions are governed by Dutch law. Disputes will preferably be resolved amicably. If necessary, they will be submitted to the competent court in the Netherlands.

 

10. Changes to the terms and conditions

10.1 Prestazione reserves the right to amend these Terms and Conditions. The latest version will always be available on www.prestazione.com
